Dan Harper should not lose his teaching certificate. We do not claim that Mr Harper did everything right, and we are also not impugning the motives of the Eanes school board or superintendent. However, we stand strongly against any action that could lead to the revocation of Mr Harper’s teaching certificate.

12/14: It's over! The board had a special meeting this morning. After just a few minutes in closed session, they came back out and withdrew the complaint.
Language of the motion, courtesy of Keep Eanes Informed:
I move that the board authorize and direct the superintendent to settle and resolve the pending litigation with Mr. B. Dan Harper, Docket Number 022-LH-1107, by accepting his letter of resignation and in return by withdrawing the proposal to terminate his contract and withdrawing the pending complaint at TEA and SBEC. I further move that the board authorize the superintendent to negotiate and enter into final settlement documents as necessary.
The motion passed unanimously.
Thanks to Clint Sayers, the board member most on the side of common sense in this matter. I'm sure we'll re-elect him in May if he chooses to serve again.
And thank you all; I think we really made a difference.
11/28: Board Meeting Report: Thanks to everybody who came! The turnout was great; we may have set an attendance record for these meetings. They had to crank up the air conditioning a couple of times.
The board arrived 20 minutes late, and then we proceeded to listen to a staggering number of really dull reports before Open Forum came up. Nancy Misage delivered an impassioned speech, outlining the case from her perspective. Other speakers included parents, alumni, students, teachers, and even a gentleman whose children and grandchildren went through Eanes. Everyone made excellent points, and finished with rousing and extended applause from the great crowd.
After the speeches, most everybody left, which strikingly illustrated how many people were there just for this issue. I stuck around in case any board member did anything interesting, but no luck. The board simply proceeded as if nothing had happened.
The only thing I can conclude is that, with a couple of exceptions, the board and administration's primary concern in this matter is the exercise and display of their own power. Power over teachers, power over the community. It remains to be seen if that mindset will survive the next elections.
Audio has been posted; I'll post transcripts if anybody sends them. I'll probably type up my own speech at some point, but not tonight. That meeting was interminable.
11/5: Board Meeting Report: After almost an hour in closed session on this issue, Mr Clint Sayers moved to withdraw the SBEC complaint, deeming it unnecessary for the board to further prosecute Mr Harper having already marked his record with their votes of no good cause and termination. Mrs Balthazar seconded, but the motion failed 2-5.
Mrs Balthazar then moved to direct the Superintendent to write a letter to the State Board of Educator Certification declaring that the intention of the district is for the maximum punishment to be a note on Mr Harper’s record. Mr Sayers said that it was silly to try to give orders to SBEC, and that he felt the position of the board and the superintendent had changed, since they knew from the beginning that license revocation was on the table, and that withdrawl would be more appropriate. He voted for the new measure, since it was the best that could be done, and it passed 6-1 (with Mr Stone dissenting). So this at least will be done, thanks to the community.
I was never recognized to speak, but was allowed to address whoever of the board wished to remain after the official meeting. The only ones who stayed (to their great credit) were Mr Sayers, Board President Jim Strickland, and Superintendent Wellman. I said that the community had not been heard on the issue, that this was giving the district and community a black eye, and that it risked chasing off the Misages and other top teachers.
Fair & Balanced: Afterwards, Mr Strickland and I chatted for a bit outside. In the interest of fairness, I’m presenting his perspective: the district acted in good faith to try to keep Mr Harper; Harper feels he’s above the rules; this action is necessary to keep order in the district; the “Westlake vs Akins” angle is not part of the issue, because it didn’t matter what Harper’s destination was; all the comments about Harper being a great teacher are not in dispute, but don’t change the facts. He also believes that Mr Harper will get no more than a slap on the wrist, and will never miss a day of class. “In the end, everybody will get what they want.” I was given no cause to doubt Mr Strickland’s sincerity.
So let’s hope his prediction is right. The next step, apart from everybody attending the next board meeting, which probably won’t change anything but which might give the community a chance to show itself, is to write to the State Board of Educator Certification. See What to Do.
11/5: A number of EISD teachers have now signed up on this site. Some of the very best are represented here, so let’s hope the district does what it takes to keep them.
11/1: Superintendent Wellman now claims that Eanes was merely reporting the issue to the state, and does not intend any harm to Mr Harper. But she is not un-doing anything that has been done. Eanes is still forwarding the case to the TEA in the exact same manner.

Mrs Balthazar and Mr Sayers generally stick up for Mr Harper. The others do not.

It’s not even clear what they’re talking about, but this seems to be where they file the ethics complaint. They seem to want to sweep it under the rug.

The Eanes school board has filed an ethical complaint against Mr Dan Harper, which could lead to the revocation of his teaching certificate for up to two years. See the front-page Austin American-Statesman article.
Mr Harper taught at Westlake High School for 22 years. He built the physics program into a worldbeater, helping a generation of Eanes kids to learn not just about how the universe works, but also about how to learn, and how to teach.
On August 3, Mr Harper accepted an opportunity to recreate his success at another school, the relatively new Akins High School in AISD.
Teaching contracts in Texas specify 45 days’ notice for resignations, in order to give schools time to find replacements. Mr Harper missed that deadline, resigning just over three weeks before school began. Apparently this contract term is rarely enforced, especially when there are top-notch teachers ready and waiting to step up, as in this case.
Pursuing action against Mr Harper has the following effects, all of them negative:
The district may technically be right here, and they may indeed have the right to go after Mr Harper. But that doesn’t make it the right thing to do. Why do they want to? After 22 outstanding years, we should be glad that we had him, not angry to be losing him.
Nothing, really, since everything is resolved. You could thank the board and/or superintendent for making the right decision in the end.
